EMS COMMAND ORDER 2009-62 UPDATE

Dear Brothers and Sisters,

As we all know the EMT’s and Paramedics are now earning shift differential while working overtime. This is a result of a current FLSA lawsuit that litigants have against the City for improper pay practices.

Since this issuance of this Order, we have worked with the FLSA attorneys and our General Counsel of DC37.

This is the course of action that will take place

  • The FLSA attorneys will continue to have litigants (3621 members) and defendants (FDNY and City) questioned.
  • The General Counsel has begun to research the legality of the actions of the Department and what will be filed, such as an improper practice. 
  • The FLSA attorneys and the General Counsel are working together to ensure a successful outcome of both issues.
  • The FLSA attorneys are working towards a successful ruling that our members are “FLSA Covered Employees”.

Once we win the ruling our members will be receiving the same compensations.
